By accessing this website, placing an order, submitting payment, or accepting delivery from Ivory Furniture Inc. (“Company,” “we,” “us,” “our”), operating as Ivory Studio, you (“Customer,” “Buyer,” “User”) agree to be legally bound by the following Terms & Conditions. If you do not agree, you must not proceed with any purchase.
1. ALL SALES FINAL – NO REFUNDS, NO EXCHANGES
All purchases made with Ivory Furniture Inc. are FINAL SALE.
We do not offer:
- Refunds
- Returns
- Exchanges
- Store credits
- Order cancellations
This applies without exception, including but not limited to:
- Change of mind
- Buyer remorse
- Incorrect selection
- Color or finish variation
- Size/fit issues
- Project delays or cancellations
- Online vs in-store purchase misunderstandings
Once payment is made, the transaction is legally final and non-refundable under all circumstances.
2. CUSTOM, SPECIAL ORDER & IMPORTED PRODUCTS
All custom, made-to-order, special-order, and imported items are:
- Non-cancelable
- Non-returnable
- Non-refundable
Any drawings, specifications, finishes, and design approvals confirmed by the customer constitute final production authorization. Ivory Furniture Inc. bears no responsibility for post-approval dissatisfaction.
3. AS-IS SALE & MATERIAL VARIATIONS
All products are sold “AS IS” and “AS AVAILABLE.”
Natural material and production variations including:
- Wood grain & knots
- Stone veining
- Fabric dye lots
- Leather texture
are not defects and do not qualify for disputes, refunds, or compensation.
Product images are for reference only and actual items may vary based on lighting, screen display, and production methods.
4. LIMITED GOODWILL MANUFACTURING DEFECT COVERAGE
Ivory Furniture Inc. provides NO expressed or implied warranties, including but not limited to:
- Any implied warranty of merchantability
- Any implied warranty of fitness for a particular purpose
Notwithstanding the above, Ivory Furniture Inc. may, as a goodwill gesture only and at its sole discretion, choose to offer limited support for verified manufacturing defects reported within twelve (12) months from the date of delivery.
This discretionary goodwill support:
- Applies only to confirmed manufacturing defects
- Does not cover normal wear and tear, misuse, improper installation, exposure to moisture or heat, modifications, commercial overuse, accidents, or damage caused by transportation, handling, or third parties
- Does not constitute a legal warranty in any form
- Does not create any contractual obligation
- May be refused at the sole discretion of Ivory Furniture Inc.
5. GOODWILL-ONLY SUPPORT (STRICTLY DISCRETIONARY)
At its sole, absolute, and unrestricted discretion, Ivory Furniture Inc. may elect to:
- Repair
- Replace parts
- Provide limited support
Strictly as a gesture of goodwill only, and not as a matter of right.
This goodwill support:
- Is not a warranty
- Does not create any legal duty or obligation
- Does not establish precedent or future expectation
- Does not waive any rights of Ivory Furniture Inc.
- May be approved or denied for any reason at the Company’s sole discretion
All goodwill requests are assessed case-by-case, and Ivory Furniture Inc. reserves the right to decline service even within the 12-month period, including in cases of unreasonable, abusive, or non-cooperative conduct.All such cases are evaluated case-by-case at the Company’s sole discretion.
6. SHIPPING, DELIVERY & RISK TRANSFER
- Risk of loss passes to the customer once goods leave our warehouse or supplier facility
- Ivory Furniture Inc. is not responsible for:
- Freight damage by third-party carriers
- Delivery delays
- Customs or port delays
- Lost or stolen shipments
- Delivery timelines are estimates only and not guaranteed
7. INSPECTION & DAMAGE CLAIMS
Customer must inspect goods immediately upon delivery.
- Visible damage must be reported within 24 hours
- Must include:
- Clear photos
- Original packaging
- Delivery documentation
- Failure to comply results in automatic waiver of all claims
- Ivory Furniture Inc. is not responsible for concealed damage or damage after installation
8. INSTALLATION & THIRD-PARTY SERVICES
Unless explicitly stated in writing, Ivory Furniture Inc. does not provide installation.
We hold no liability for:
- Third-party contractor workmanship
- Structural or electrical suitability
- Improper placement or handling
9. PAYMENT TERMS & CHARGEBACK DISPUTES
- Deposits are non-refundable under all circumstances
- Full payment may be required prior to delivery
- Any chargebacks or payment disputes after delivery constitute a breach of contract
- Ivory Furniture Inc. reserves the right to submit:
- Signed quotes
- Delivery confirmation
- Photographic proof
to financial institutions and pursue recovery, collections, or legal remedies
10. STORAGE & ABANDONED GOODS
Delayed pickup or refusal of delivery may result in:
- Storage fees
- Goods unclaimed after 30 days deemed abandoned
- Right of resale or disposal without compensation
11. LIMITATION OF LIABILITY
Under no circumstances shall Ivory Furniture Inc. be liable for:
- Indirect or incidental damages
- Business interruption
- Lost profits
- Project delays
- Emotional distress
Total liability, if any, is strictly limited to the amount paid for the product only.
12. DISPUTE RESOLUTION, ARBITRATION & CLASS ACTION WAIVER
All disputes:
- Shall be governed by the laws of British Columbia, Canada
- Must be resolved through binding private arbitration
- Customer waives rights to:
- Class actions
- Small claims court actions
- Jury trials
13. FORCE MAJEURE
The Company is not liable for delay or failure caused by:
- Acts of God
- Supplier failure
- Customs delays
- Freight disruption
- Government restrictions
- Labor strikes
14. WEBSITE CONTENT & PRICING ERRORS
Ivory Furniture Inc. is not responsible for:
- Typographical errors
- Pricing inaccuracies
- Inventory mismatches
Orders affected by such errors may be canceled without liability.
15. CUSTOMER ACKNOWLEDGEMENT & CONSENT
By placing an order, submitting payment, or accepting delivery, the customer acknowledges that they:
- Have read and understood these Terms & Conditions
- Understand that ALL SALES ARE FINAL
- Waive chargeback rights for non-fraud reasons
- Accept these terms as legally binding
16. GOVERNING JURISDICTION
All matters shall be governed exclusively under the laws of the Province of British Columbia, Canada.
